This website was originally created by the Alice Barker Trust, immediately before a Court of Appeal hearing on the 28 March 2012, (legal reference given under RUDEWICZ menu tab). The aim was to provide evidence, that in Elzbieta Rudewicz -v- the Ministry of Justice, the MoJ misled on relevant exhumation law, at a judicial review on the 18 October 2011, Lady Justice Hallett DBE., Mr. Justice McCombe, the Claimant and the Intervening Parties. Note that in the two appeals which followed, the Respondent was the Secretary of State for Justice and not the MoJ. The publicly funded litigation, centred on whether a religious order can trump a very close relative, in applying for an exhumation licence. Elzbieta Rudewicz was attempting to prevent the Marian Fathers, from exhuming from Fawley Court in Oxfordshire, the body of Father Jozef Jarzebowski. ("relative")
